There are no time limits or a requirement for commander approval for filing informal complaints.

What is required when discrimination allegations are older than 60 days?

Please remember if your allegations are older than 60 days, you must obtain a waiver from the Installation Commander coordinated through your local EO Office.

What must a DoD civilian employee do before filing a formal discrimination complaint?

An aggrieved DoD Civilian employee who believes that he/she has been discriminated against on the basis of race, color, religion, sex (including pregnancy, gender identity, and sexual orientation when based on sex stereotyping), national origin, age, disability, or genetic information, must consult an EO Counselor before filing a formal complaint.

When must a DoD civilian employee initially contact an EO Counselor?

In order for the complaint to be processed at the formal stage, initial contact must be made within 45 calendar days of the incident or when he/she becomes aware of the personnel action.

Who may seek assistance from an EO Advisor for discrimination or sexual harassment?

An Active Duty Member (including active duty family members and retirees) who believes that he/she has been discriminated against on the basis of race, color, religion, sex, sexual orientation, national origin, or who believes they have been subjected to sexual harassment, may seek the assistance of an EO Advisor.
