Obtain copies of any written agreements between LLC members that describe the entity and the members’ understanding about its operation. (paragraph 2)
Clear the owner and the FSO in connection with the FCL. (paragraph 2)
DSS will process this type of FF for an FCL in the same manner as any other U.S. company in accordance with the provisions of this section. (paragraph 2)
Provide the contractor with immediate written notice that includes the reasons, ramifications, and required actions to bring the FCL back into a valid status, along with a specific time frame for corrective actions. (paragraph 3)
Review the details of the invalidation provided by DSS and make a risk management decision whether or not the contractor should be permitted to continue performing on their classified contracts, to include the ability to issue new subcontracts. (paragraph 3)
